PROJECT ADVISORY AND CONTRACT MANAGEMENT

Archeus Law has a dedicated project management and advisory team, providing bespoke end-to-end advisory services, particularly to clients in the infrastructure construction, energy and mining sectors. This team has been instrumental in structuring project contracts and resolving day-to-day legal and commercial issues arising therefrom. The team’s remit also extends to providing advisory services on all legal issues arising during the life cycle of projects, including on myriad issues under labour, environmental, industrial and commercial laws. Crucially, the team assists the clients in pre-empting all potential areas of disputes and ensuring the formulation of action plans to ensure their proper measures of dispute management and control (avoidance, resolution, escalation or protection) are taken in a timely manner. This also ensures that any escalated disputes are seamlessly transitioned towards formal dispute resolution mechanisms, giving the client an edge during adjudication.

Moreover, Archeus Law’s advisory services also include assistance in contractual interpretation, documentary support, corporate secretarial support, mergers and acquisition support (including strategy, target diligence and transactional assistance), assistance towards compliance and consent management, as well as representation during negotiations. Archeus Law also has tie-ups with experienced and reputed technical specialists for diverse areas such as construction planning, scheduling, delay analysis and claim quantification, and their services are also stitched into our overall project management and advisory services, when needed.

Project advisory and contract management support to a leading PRC-based specialist metro rail construction company and its Indian subsidiary, in relation to their metro projects in three major cities of India. The scope of work includes advising on day to day legal and commercial issues arising under the main contract, structuring, and evaluating bids for sub-contracting various specialized works, and other ancillary areas such as technical specifications, insurance, and labour.

Project advisory and contract management support to a leading PRC-based project management company and construction company, in relation to their power projects in India and foreign jurisdictions. The scope of work includes transaction and dispute resolution support, advising on day-to-day legal and commercial issues arising under the EPC contract, structuring and evaluating bids for sub-contracting various specialized works, and other ancillary issues such as technical specifications, insurance, labour, and security documentations.

Advisory services rendered to a major state highway and bridge construction entity, as its principal legal advisor on its various PPP/turnkey roads and bridges projects. The scope of work included advise on evaluation of project-related issues, claim management and assistance in restructuring of a project.

Legal advisory and contract management support to a global oil and gas multinational company, in relation to their projects in India. The scope of work includes advising on day-to-day legal and commercial issues, FEMA, Reserve Bank of India compliances, real estate due diligence, international trade, and other ancillary areas such as insurance and labour.

Project advisory and contract management support to a major Korean entity working in the field of power plant operation and management (O&M), as to its works in India. The scope of work included advise on evaluation of day-to-day legal matters and contractual issues with counterparties for operation and procurement.
